WEDDING PHOTOGRAPHY SERVICES CONTRACT TERMS

This constitutes an agreement for photographic services. It is also understood that all digital images remain the property of Digital Images by Pablo and they may be used for advertising, display or any purpose thought proper by Digital Images by Pablo and/or the photographer.

The photographer for this event will be Pablo Custodio. Photographer may substitute another photographer to take the photographs in the event of photographer’s illness, family emergencies, or scheduling conflicts beyond the control of the photographer. In the event of such substitution, photographer warrants that the photographer taking the photographs shall be a competent professional and made available at No Extra Charge.

Digital Images by Pablo and the photographer(s) shall not be held accountable for any unforeseen delays in the order(s). All digital images will be kept on a cd/dvd for no more than one year and may be purchased by the client after that time. It’s the clients responsibility to contact the photographer to purchase their digital images.

If the photographer cannot perform this Contract due to fire or other casualty, theft, strike, act of God, or other cause beyond the control of the parties, or due to photographer’s illness or emergency, then the photographer shall return the retainer to the Client but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in the processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the photographer. Although all care will be taken with the digital media and photographs taken at the wedding, the client agrees that the photographer limits any liability for loss, damage, or failure to deliver pictures, for any reason, to no more than the return of all payments made.

Photographer is the sole professional photographer allowed to photograph the event. Amateur photographers/video may take photos/video during the event if they do not interfere with the contracted photographer. No photo cameras or video cameras are allowed to take photographs/video when we photograph your portrait photos. If interference happens, the contracted photographer will notify the designated family representative on site to handle the situation.

Upon signature, photographer reserves the time and date agreed upon, and will not make other reservations for that time and date. For this reason, all payments are non-refundable and non-transferable, even if the date is changed, postponed or the wedding is canceled for any reason.

A $200 non-refundable retainer is due at the signing of this contract. The remainder of the balance is to be paid two weeks prior to the service date. The photographer is not bound until the non-refundable retainer is paid and accepted and this agreement is signed.
